RERA Escrow Off-Plan — Law 8/2007
What is an escrow account for off-plan properties in Dubai?
A RERA escrow is a legally prescribed trust account under UAE Law 8/2007. All buyer payments for an off-plan project are held in a trust account at a RERA-accredited UAE bank. The developer can only draw on the funds in relation to construction progress — after independent confirmation by a RERA-certified project manager. This is the central buyer-protection mechanism of the Dubai off-plan market.
Structural mechanics
1. Licensing
Before a developer may sell an off-plan project, it must apply to RERA for a project licence and open an escrow account at one of the accredited banks. The escrow account number becomes part of the public project licence. What RERA institutionally provides as Dubai's real estate regulator — licensing, trust account supervision, project manager accreditation — is documented in detail.
2. Payment flow
Buyers transfer each payment plan instalment directly to the trust account — not to the developer. The bank registers each deposit as earmarked for this project. 3. Release of funds
The developer applies for a disbursement against a construction progress report certified by the RERA project manager. The bank releases only the corresponding percentage — the remainder stays locked to secure future construction phases.
4. Reserve portion
RERA retains a 5% reserve portion, which is only released after handover and the 1-year defects liability period — as additional protection against construction defects.
What escrow is not
Not comprehensive cover. The escrow protects against misappropriation of buyer funds by the developer — it does not guarantee completion on schedule, the promised construction quality or the future market value. These structural risks remain with the buyer and are part of the AXD Tier-1 selection logic.
Verification for DACH investors
- Check the escrow account number in the RERA project licence (Dubai REST app or DLD)
- Match the bank address against the RERA whitelist (Mashreq, ENBD, ADCB, etc.)
- Confirm in the Form-4 SPA that all payments are made via the trust account
- Never transfer directly to a developer account without trust account verification
