Smart Rental Index — how much rent increase Dubai owners may actually enforce
Dubai is not a free rental market in the classic sense. Owners may increase the rent only within a firmly defined corridor — and this corridor is not negotiated, but calculated from the RERA Smart Rental Index, a public rent register that is updated quarterly by the Dubai Land Department. The legal basis is Decree No. 43 of 2013, which defines five tiered increase zones. DACH investors calculating a buy-to-let model must know this mechanism in the underwriting, otherwise the assumed rent increase collapses.
The five increase zones under Decree 43 of 2013

If the current contract rent is already above the market average or at most 10 % below it, no increase at all is permissible — regardless of how long the tenant has already lived in the apartment.
The Rental Increase Calculator — mandatory reference
The Dubai Land Department provides the binding calculator via two routes: (a) the Dubai REST App (Dubai Real Estate Self Transaction), the official DLD app for landlords and tenants; (b) the web portal dld.gov.ae under Services → Tools → Rental Increase Calculator. Inputs are community, tower/building, property type (studio/1BR/2BR/villa), number of bedrooms and the current contract annual rent. The system returns the increase corridor, reconciled with the current Smart Rental Index. The Smart Rental Index itself is based on Ejari data — all registered tenancy contracts in Dubai (registration is mandatory for every tenancy contract under the Ejari obligation). The index is therefore empirically robust and cannot be influenced by brokers.
The 90-day notification obligation
A planned increase must, under Law No. 26 of 2007 (Art. 14, supplemented by Law No. 33 of 2008), be served on the tenant in writing at least 90 days before contract expiry. If the owner misses the deadline, the contract renews automatically on unchanged terms — and for the following period no increase can be enforced, even if the index would permit it. Recommended form of service: notary notification, registered letter with acknowledgement of receipt, or documented personal delivery. SMS or WhatsApp are not sufficient. Practice for DACH owners from a distance: instruct a property manager that triggers the 90-day notice automatically.
Dispute — the Rental Disputes Center (RDC)
If the tenant refuses the index-compliant increase, the owner can call on the Rental Disputes Center (RDC) at the DLD. The RDC decides on the basis of the Smart Rental Index — the calculator value is in effect binding. Procedure duration typically 30–60 days, fee 3.5 % of the annual rent (minimum AED 500, maximum AED 20,000). During the proceedings the tenant remains in the property on the old terms. Consequence for DACH underwriting
Rent increase assumptions above 5 % p.a. in the model are realistic in Dubai only if the apartment was let clearly below the market index — otherwise Zone 1 applies (0 % increase). On re-letting (change of tenant) there is no index binding — the owner may let freely at the current market price. Holiday-home / short-term rental (via DTCM licence) is not subject to the index — Decree 43/2013 applies only to residential long-term tenancy contracts.
