Title Deed Dubai — how German buyers obtain the ownership certificate

The Title Deed (Sanad Milkiyya) is the constitutive ownership certificate of the Dubai Land Department. In off-plan purchases, initially only a contingent right arises in the Interim Real Estate Register (OQOOD) under Dubai Law 13/2008. Only upon Final Payment, building completion and Trustee Office transfer is the Title Deed issued under Dubai Law 7/2006 — against a 4 % transfer fee and DLD admin fees of approximately AED 4,500–11,000.

What is stated on the Title Deed

  • Ownership structure: Freehold (full right), Leasehold (heritable building right, 99 years), Usufruct, or Musataha
  • Owner identification: full name, passport number, nationality
  • Unit: plot number, building name, unit number, floor, gross area m² / sqft
  • Location: community (e.g. Downtown Dubai), sub-community, master plan reference
  • Encumbrances: mortgage, caveat, restriction (if registered)
  • Issuance Date + DLD Reference Number — verifiable online via the DLD REST portal

Handover by Special Power of Attorney

Around 70 % of DACH buyers complete the handover by SPOA — physical travel to the Trustee Office is not required. The workflow: draft the SPOA through a UAE-licensed lawyer, limited in content to specific transfer actions plus DLD representation. Signature before the Notary Public in Dubai or at the German Embassy in Berlin / Consulate in Munich. Certification by the German Federal Foreign Office + apostille via the Federal Office of Administration. Translation into Arabic by a UAE-certified legal translator + certification by the UAE Ministry of Foreign Affairs and International Cooperation (MOFAIC). In addition: POA for Dubai property purchase.

Practical notes for DACH investors

  • Conduct the snagging inspection before Final Payment — see Snagging Checklist.
  • Verify the Title Deed digitally in the DLD REST portal — authenticity is checkable via QR code.
  • Store the original document securely (bank safe deposit box Dubai or Germany) — loss leads to duplicate issuance against a fee of AED 250 plus identity procedure.
  • On sale or inheritance: the Title Deed is the only legally binding document — the SPA loses its significance as proof of ownership after Title Deed issuance.
  • For later DACH inheritance: DIFC Will for inheritance.
