Rental Dispute Center — Rent Claims for DACH Landlords

The Rental Dispute Settlement Centre, established by Dubai Decree No. (26) of 2013, is the sole jurisdiction for rental disputes in Dubai Mainland. As a DACH owner who lets an apartment via remote management, you will have to litigate here in the event of rent default — not before the ordinary courts in Dubai and certainly not in Germany. The procedure is leaner compared with DACH practice and strongly tied to an active Ejari tenancy contract. Anyone who lets without Ejari has, in practice, no basis for enforcement in a dispute.

Typical Grounds for Claim and Conditions for Success

Rent default: promising in the case of dishonoured rent cheques, provided the tenancy contracts are registered in Ejari and the cheques were presented within the statutory period. Contract breaches: subletting, holiday-home use without a DTCM licence, commercial use of residential property. Eviction at the end of the contract: requires 12 months' notarial advance notice pursuant to Law 33 of 2008. Rent increase dispute: RDC arbitration on the basis of the Smart Rental Index per Decree 43/2013.

What DACH Owners Must Practically Observe

Without an active Ejari entry, practically no claim is possible — register Ejari immediately after conclusion of the tenancy contract. Rent payment via cheque instalments facilitates enforcement; SEPA transfers are simpler from a DACH perspective but more burdensome in documentary terms in the RDC procedure. A Power of Attorney for a local lawyer should be arranged before letting — otherwise, in the event of rent default, you lose 2–4 weeks of processing time. Keep an updated copy of the Title Deed and certified proof of ownership (in particular where held via a GmbH holding) ready in the file.
